What Are 601-A and 601 Waivers?

The 601-A provisional waiver, also known as an unlawful presence waiver, helps certain family members of U.S. citizens or lawful permanent residents. It addresses their inadmissibility due to unlawful presence in the United States.  

This waiver only applies to individuals who have accrued unlawful presence, but they do not have other disqualifying factors such as criminal convictions. Applicants must show that their U.S.-based qualifying relative would suffer extreme hardship if the waiver is denied.  

The 601-A waiver allows applicants to address their inadmissibility before departing the country for consular processing, reducing the time spent separated from their families.

The 601 waiver serves a broader purpose. It addresses multiple grounds of inadmissibility, including unlawful presence, criminal activity, or fraud and misrepresentation. Unlike the 601-A, this waiver does not limit its scope to unlawful presence.
